The Weight of Inheritance

We do not choose the historical moment into which we are born, nor the legacies it deposits in us. This is a philosophical commonplace but it becomes pressing when those legacies include injustices committed before one's birth — injustices whose effects persist into the present in ways that are measurable, even as the moral accountability for them is contested.

The debate about historical reparations is a version of this problem. It asks not merely whether past wrongs were wrong — on that there is often agreement — but whether present people have obligations arising from wrongs committed by predecessors whose actions they did not choose and could not have prevented. The philosopher Jeremy Waldron has argued for what he calls "supersession" — that the moral force of historical injustices can be attenuated by subsequent changes that have altered the baseline against which claims must be assessed. Others, including Janna Thompson, have argued for an intergenerational model of moral responsibility in which communities carry obligations across time.

Neither position is obviously correct, and the difficulty is not merely technical. It involves deep questions about the nature of identity — of personal identity and of collective identity — that philosophical analysis has not resolved.

What is perhaps most important in this debate is the prior question it conceals: what purpose reparations or other remedial measures would serve. If the purpose is primarily compensatory — to restore what was taken — the accounting is one kind. If the purpose is primarily forward-looking — to alter structural conditions that persist from historical injustice — the accounting is different. These purposes overlap but are not identical, and the confusion between them has complicated many public discussions that might otherwise have been more tractable.
